FAILURE TO REGISTER AS A SEX OFFENDER

  1. DismissedFailure to Register as a Sex Offender, a class 4 felony. Defendant had serious mental health problems. Defendant found not competent to assist in his defense and not restorable to competency. Maricopa County Superior Court.
  2. DismissedFailure to Register as a Sex Offender, a class 4 felony. Dismissed after defense pointed out to the state's prosecutor that the law did not require the defendant to register as a sex offender. Maricopa County Superior Court.

SEXUAL ABUSE

  1. Defendant pled to a non-sex offense. Defendant charged with 2 counts of Sexual Abuse, class 5 felonies. Negotiated a plea to drop the sex abuse in exchange for a plea to assault, a class 3 misdemeanor. Defendant did not have to register as a sex offender and did not get a felony conviction. Maricopa County Superior Court.

SEXUAL ASSAULT (This is Arizona's Rape Law)

  1. Dismissed day of trialSexual Assault (of a spouse), a Class 6 felony, Kidnapping, a class 2 dangerous felony, Aggravated Assault, a class 3 felony and dangerous felony, Escape, a class 5 felony, and misdemeanor Threatening and Intimidation. Maricopa County Superior Court.
  2. Dismissed prior to trialSexual Assault, a class 2 felony and dangerous offense, Kidnapping, a class 2 felony and dangerous offense, Aggravated Assault, a class 3 felony and dangerous offense. Defense investigation revealed that the accuser had credibility problems. Maricopa County Superior Court.
  3. Defendant pled to lesser offense of misdemeanor assault. Defendant charged with Attempted Sexual Assault, a class 3 felony and misdemeanor assault. Negotiated a deal where the defendant did not have a felony conviction or a sex related conviction nor did he have to register for the rest of his life as a sex offender as he would have if he had lost at trial. Maricopa County Superior Court.

SEXUAL CONDUCT WITH A MINOR

  1. Defendant pled guilty to a non-sexual charge of Child Abuse, a class 6 felony and did not have to register as a sex offender. Originally, defendant was charged with Sexual Conduct with a Minor, a class 2 felony and Dangerous Crime Against Children. Defendant was facing mandatory 13 years to 27 years flat time in prison and mandatory lifetime sex offender registration if he lost at trial. Originally, the prosecutor offered lifetime probation with sex offender registration. Defense investigation revealed serious problems with accuser's credibility. Defendant was able to plead guilty to hitting the accuser one time with his hand in exchange for the sex case being dismissed. Maricopa County Superior Court.
