Armed Robbery

  1. Not guiltyArmed Robbery, a class 2 dangerous felony – Jury Trial. Guilty of lesser of misdemeanor theft. Defendant faced 7 years to 21 years mandatory prison at trial. Offer was 5 years prison. Sentenced to time served. Maricopa County Superior Court.
  2. Not guiltyArmed Robbery, a class 2 dangerous felony – Jury Trial. Guilty of lesser of misdemeanor theft. Defendant faced 7 years to 21 years mandatory prison at trial. Offer was 7 years prison. Sentenced to time served. Maricopa County Superior Court.
  3. Dismissed two days prior to trial – 2 counts Armed Robbery, class 2 dangerous felonies, Theft of Means of Transportation, a class 3 felony, and Theft of a Credit Card, a class 5 felony. Defendant faced at least 9 years prison up to 46 years prison if convicted at trial. Set for trial and the state had to dismiss. Maricopa County Superior Court.
  4. Defendant pled to probation with 1 year in jail for Armed Robbery. Defendant was facing 7 years to 21 years mandatory prison if he lost at trial. Original offer was 5 years in prison. We got the case remanded to the grand jury after demonstrating that the prosecutor failed to fairly and accurately present the facts to the grand jury. Further defense investigation revealed that the victim had a propensity for violence that supported the defendant's claim of self-defense. Defendant chose to accept the improved offer rather than go to trial. Maricopa County Superior Court.
  5. DismissedArmed Robbery, a class 2 dangerous felony and Kidnapping, a class 2 dangerous felony. Maricopa County Superior Court.
  6. DismissedArmed Robbery, a class 2 dangerous felony. Defendant facing 10.5 years to 21 years flat time and mandatory prison if he lost at trial. Defense investigation revealed that this was a case of mistaken identification. Defense filed a motion to send the case back to the grand jury as well as a motion to suppress defendant's statements to police due to improper police conduct. The prosecutor responded to the motions by dismissing the case. Maricopa County Superior Court.
  7. Defendant pled to the lesser offense of Class 2 Armed Robbery non-dangerous felony and received probation with one year in jail. Defendant charged with 2 counts of Armed Robbery, class 2 felonies. Defendant faced a minimum of 7 years mandatory prison up to 42 years if he lost at trial as charged. State improved the offer after the Dessureault (pre-trial identification) hearing revealed major inconsistencies between the accusers' accounts and defendant decided to accept the dramatically improved offer. Maricopa County Superior Court.
